Sharing Happiness Party Designs

1. Acceptance of These Terms

By accessing or purchasing from Sharing Happiness Party Designs ("we," "our," "us"), you ("you," "your," "Customer") agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use our site or services.

2. Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to place an order. By purchasing, you affirm that you meet this requirement and have the legal capacity to enter into a contract.

3. Products & Customizations

Hand‑crafted physical goods. All items are made to order; slight variations may occur.

Custom-Made Products – All items are produced on demand and personalized based on the information you provide.

Color & Screen Variations

Colors may look slightly different in person vs. on screen or across different devices. Such minor variations are normal and not considered defects.

Proof & Personalization Check

Proofs & Approvals – If we send a digital proof, you are responsible for verifying spelling, dates, colors, and layout. Once you approve (or if approval is waived), changes cannot be made.

Proof Approval: Once you approve the proof (or, for designs without a proof, once the order is placed), we cannot cancel or change the order.

Spelling & Details: We create your items exactly as submitted. Double-check names, dates, and colors before approving your proof.

Character Limits – To ensure designs fit, we may adjust font size or layout of names or text at our discretion.

Customization requests. Custom designs, colors, text, or sizing must be approved in writing before checkout and will incur a customization fee.

Please email support@sharinghappinesspartydesigns.com before placing your order for any changes to color, quantity, or design. Please note that custom changes or additions incur a customization fee. We look forward to creating one-of-a-kind party pieces that make your celebration shine!

4. Ordering & Payment

Orders are confirmed only after full payment has cleared. We accept major credit/debit cards, Shop Pay, and other payment methods listed at checkout. Prices are displayed in U.S. Dollars and do not include applicable taxes, duties, or shipping fees.

Chargeback & Payment-Dispute Policy

(Applies to all custom-made products ordered through our website)

Custom items are made especially for you, and we stand behind our work. To keep the process fair for everyone, please read and agree to these terms before completing payment.

1. No-Return/No-Refund Acknowledgment & First-Contact Rule

Our No Return / No Refund policy is clearly stated on the site and acknowledged at checkout.

Because every item is created just for you, all sales are final—no returns or refunds. Initiating a chargeback is a violation of these terms.

2. Proofs & final approval

You approve all spellings, colors, and layouts before production. After approval, the order is final sale. “Changed my mind” or “not as described” claims are not valid reasons for a chargeback on a custom product.

3. Evidence we keep on file

For every order we save:

Timestamped proof approvals

Production photos

Shipping invoices, tracking numbers, and carrier delivery scans

If a chargeback is filed, these documents are supplied to the card issuer.

4. Administrative fee for unwarranted chargebacks

Filing a chargeback without first giving us the chance to fix the problem is treated as misuse of the payment-dispute process.

If the bank rules in our favor, you agree to pay a $35 administrative fee to cover investigation costs and bank penalties.

5. Order suspension & future service

Any open orders linked to an unresolved or fraudulent chargeback will be suspended. We may refuse future sales to accounts that initiate unwarranted disputes.

6. Governing law

All payment disputes are governed by New Jersey law. You consent to exclusive jurisdiction and venue in New Jersey courts for any claim arising from a transaction with us.

By clicking “Pay now” at checkout, you certify that you have read, understood, and agree to this Chargeback & Payment-Dispute Policy, and you commit to working with us in good faith to resolve any issue before contacting your bank.

5. Pricing, Taxes & Duties

Prices may change without notice. You are responsible for any sales tax, VAT, customs duties, or similar charges required by your locale. Shopify calculates U.S. sales tax at checkout where applicable.

6. Shipping & Delivery (Physical Goods)

Shipping & Delivery Policy

1. Production & Invoicing

Made to Order: Each of our party goods is lovingly handcrafted and personalized to celebrate your honoree—made to order just for you.

Production Time: 10–20 business days* from your order date.

Shipping Invoice Notification: Whenever your order is completed, we will email you the shipping invoice—this may happen at any point during the 10–20 business-day production window.

Carrier: We ship all orders using UPS only.

Optional Insurance – Recommended for time-sensitive or high-value orders; contact us before paying your shipping invoice.

Shipping Invoice: Once production is complete, we’ll calculate the exact UPS shipping cost, issue a separate invoice, and hold your order for shipment until the invoice is paid.

Invoice Payment & Dispatch: After you pay your shipping invoice, we will ship your order the next business day.

*Business days exclude U.S. public holidays and weekends.

2. UPS Domestic Shipping Options(We currently ship exclusively to the 48 contiguous U.S. states.)

UPS Ground—economy ground delivery within 1–5 business days

UPS 3 Day Select—delivery in 3 business days

UPS 2nd Day Air—delivery in 2 business days

UPS Next Day Air Saver—Next-day delivery by end of day, 1 business day

UPS Next Day Air—Next-day delivery by 10:30 AM local time, 1 business day

Note: Actual shipping charges vary by weight, dimensions, and ZIP codes.

3. After Shipment

Once your package leaves our facility, all transit, delay, loss, or damage issues are the responsibility of the carrier.

7. Returns, Exchanges & Order Cancellations

Each order is custom-made, so we cannot accept returns or cancellations once production begins. If you’d like to change the theme or swap items, email us right away—adjustments are only possible before we start crafting. When changes increase the order total, we’ll invoice you for the price difference before proceeding. 8. Intellectual Property

All designs, artwork, photographs, text, logos, and trade dress are our exclusive property and protected by U.S. and international copyright and trademark laws. You may not reproduce, resell, or distribute our content without prior written consent.

9. User‑Generated Content

If you tag us on social media or submit reviews/photos, you grant us a worldwide, royalty‑free license to display, reproduce, and use that content for marketing, in any medium, without additional compensation.

10. Prohibited Uses

You agree not to:

Use our products for unlawful, harmful, or defamatory purposes.

Reverse‑engineer or copy our designs for resale.

Upload malicious code or attempt to disrupt our website.

Acceptable Use Guidelines

When you visit or use our site, you agree not to:

Use the site or its content for anything illegal, unethical, or unauthorized.

Violate our copyrights, trademarks, or any other intellectual-property rights—or those of anyone else.

Disable, hack, or bypass the security features of this site, other sites, or the internet as a whole.

Reproduce, distribute, sell, or otherwise exploit any part of the site or its content unless we have given you written permission.

Our products and services are provided “AS IS” and “AS AVAILABLE.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement.

15. Limitation of Liability

In no event shall we be liable for indirect, incidental, special, or consequential damages arising out of or related to your use of our products or site. Our maximum aggregate liability shall not exceed the amount you paid for the specific order giving rise to the claim.

16. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including attorneys’ fees) arising out of your breach of these Terms or misuse of our products.

17. Governing Law & Jurisdiction

These Terms are governed by the laws of the State of New Jersey, U.S.A., without regard to conflict‑of‑law provisions. Any dispute shall be resolved exclusively in the state or federal courts located in New Jersey, and you consent to personal jurisdiction therein.

18. Dispute Resolution & Notice

Before filing a claim, you agree to contact us at support@sharinghappinesspartydesigns.com and allow 30 days to resolve the issue informally.

19. Changes to These Terms

We may update these Terms from time to time. Changes take effect once posted on our website. Continued use after changes constitutes acceptance.

The latest version of our Terms is always available right here.

We may revise or replace any section by posting an updated version on this page.

We’ll do our best to alert you to major changes, but please check this page each time you visit. Continuing to browse or use the site means you accept the updated Terms.

If you buy something, the Terms that apply are those in effect on the day you place your order, so we recommend printing or saving a copy for your records.

This site runs on the Shopify platform, which powers our online store and secure checkout.

20. Severability

If any provision is found unenforceable, the remainder of the Terms will remain in full force and effect.

21. Entire Agreement

These Terms, together with our Privacy Policy and any order confirmation, constitute the entire agreement between you and Sharing Happiness Party Designs.
